SCOTUS Actions in Two Broadcast Indecency Cases      5/7/2009

The U.S. Supreme Court has acted on two cases involving the Federal Communications Commission's (FCC) ability to fine indecent broadcasts. Both cases, the Golden Globes/fleeting expletives case and the Janet Jackson Super Bowl wardrobe malfunction case, were remanded to the lower courts. Pat Trueman, Special Counsel with the Alliance Defense Fund, says that while the high court upheld the fine against the broadcasters, it handed both cases back to the lower court to focus on the constitutional issue of the FCC's broadcast indecency enforcement. While this is very good news at first blush, Trueman says there could be trouble ahead for families if there are any further changes to the make-up of the Supreme Court by the time these cases return.
