Life and Death of the 'Empathy Standard' 8/7/2009 President Obama has lost more than he gained with the nomination of Judge Sonia Sotomayor to the United States Supreme Court. Though Sotomayor’s confirmation is now behind us, any reasonable person who followed the hearings closely has to admit that the president’s entire approach to judicial nominations has been compromised.
The famous “empathy standard” suffered a devastating blow at the hands of Senator Jeff Sessions (R-Ala.) who led the Republican charge that discredited it thoroughly in the hearings.
