Virginia Court of Appeals Custody Ruling Upholds Parents' Rights 6/5/2008 Click for more multimedia content.
This week, the Virginia Court of Appeals upheld parental rights by turning away the notion of "de facto" or "psychological" parenthood - the claim based on an emotional attachment with the child rather than by birth or adoption. The Stadter v. Siperko ruling involved a former lesbian couple where only one member has a biological or adoptive relationship with the child born by artificial insemination while the couple was together. The circumstances of this case are very similar to the case of Lisa Miller, yet the same appeals court reached a very different conclusion in the Miller case. Matt Barber, CWA's Policy Director for Cultural Issues spoke with Mat Staver, Founder of Liberty Counsel and Dean of the Liberty University School of Law on the implications of the Stadter case on the Miller case, which is currently being appealed to the Virginia Supreme Court, as well as how those, combined with the recent California court ruling that is allowing same-sex marriages to go forward, can soon unravel the fabric of marriage and family law nationwide.
