Iowa Judicial Activists Trample on Marriage and the Constitution 4/3/2009 Washington D.C. – By striking down Iowa’s marriage law that defines marriage as the union between one man and one woman, the Iowa Supreme Court highlights the danger of judges who believe that the Constitution is a living, breathing document changing with the times— and that they are the ones who decide what those changes should be.
Concerned Women for America (CWA) President Wendy Wright said, “Marriage is a civilizing institution that brings a man and a woman – two fundamentally different yet complementary people – together in an unparalleled bond that provides children with the benefits of the two sexes, male and female. The Iowa justices in reality regress in their attempt to impose ‘progress’ by destroying the concept of marriage in a naked, self-serving power grab. Claiming that they have a ‘keen and respectful’ understanding of the Constitution doesn’t make it so, anymore than claiming marriage can be complete without one or the other sex.”
Mario Diaz, Esq., CWA’s Policy Director for Legal Issues, said, “In this opinion, the justices act as a legislature, marriage counselor, psychologist, advocates, even priests or pastors, but not as judges. Today, they have not only opened the door to same-sex ‘marriage’ but, if you are bisexual and are ‘in love’ with a man and a woman, you should be able to go to Iowa and marry them both. According to them, to say ‘no’ would be ‘discrimination’ based on your ‘sexual orientation.’”
Tamara Scott, CWA of Iowa State Director, had this to say: “This case proves once again that the only way to assure that the institution of marriage is protected in Iowa is to pass a constitutional marriage amendment. Iowans need to look to the people of California for encouragement and begin working today to pass an amendment by asking our legislators to allow us a vote on an amendment. Sitting legislators should not only support a bill that would allow Iowans a say in the vote, but they should demand their constituents’ voices be heard by sponsoring the bill and offering to bring it to the floor. Any legislator not willing to sponsor such a bill is proving their loyalty is with political agendas and not with the people of Iowa or the intent of our Founding Fathers.”
