
Military Victory in the First Circuit Court

On Monday, June 9 the U.S. Court of Appeals for the First Circuit, based in Boston, upheld the constitutionality of the 1993 law on homosexuals and the military. This case, Cook v. Gates, is a major victory. The case was brought by twelve homosexuals who were discharged from the military. Homosexual activists had hoped that the U.S. Supreme Court ruling in Lawrence v. Texas, which legalized sodomy in all 50 states, would have given them a court victory against the law which bans homosexuals from military service. While we have a victory in this case, Elaine Donnelly, President of the Center for Military Readiness, says that other challenges remain, including an attempt in Congress to abolish the 1993 law.
